QUESTIONS FOR REVIEW

1) The Government, either State or Federal is always the “Plaintiff,” but in criminal cases it is simply the prosecutor not the plaintiff. The government’s laws are the ones that were broken, and they are the ones that bring charges.

2) A misdemeanor is a criminal offense that is less serious than a felony. A felony is the term used for very serious crimes.

6) The rule of felony murder is a legal doctrine in some common law jurisdictions that broadens the crime of murder in two ways. First, when an offender kills accidentally or without specific intent to kill in the commission of a felony, the offender can be charged with murder. Second, it makes any participant in such a felony criminally liable for any deaths that occur during or in furtherance of that felony.

7) An individual committing robbery steals something from someone by using force or intimidation. Burglary involves breaking into a building with the intent to commit a crime.

8) Defense of family members- as in the case of self defense, the rescuer must have good reason to believe that the victim was in danger of sever bodily injury or even death, Again, the rescuer need not retreat if the attack on the family member takes place in his or her own house.

9) White Collar Crime is crime perpetrated by the people put in power at an organization
Embezzlement- Using of company funds for Personal Use
Accounting Fraud- manipulating company books to distort the financial position of a company (hide embezzlement, make the company look like its doing better etc)
Insider Trading- using non public information to sell or buy stock before the general in order to make money/ save loss from good or bad news
Tax evasion- not paying your taxes or using fake information to lower the amount of taxes you owe
